TO WHOM IT MAY CONCERN:

NOTICE IS HEREBY GIVEN, the Planning Commission of the City of Rosemount will hold a Public Hearing to consider the item listed below on Tuesday, August 28, 2012, the Council Chambers of the City Hall, 2875 145th Street West, Rosemount, Minnesota, and beginning at 6:30 p.m. or as soon thereafter as possible. The purpose of the public hearing is to receive public comment on the applications submitted by Dakota Aggregates, LLC, for a large scale mineral extraction permit and an interim use permit to allow mining and aggregate processing on property located within UMore Park. Interim use permit is requested to accommodate 40 years of mining and operating the associated ancillary uses. The ancillary uses include aggregate processing, concrete production, asphalt production, vehicle maintenance, and concrete product casting. The Public Hearing pertains to property owned by the Regents of the University of Minnesota located south of County Road 42, east of Highway 3, and west of Akron Avenue, legally described as follows:

1.Legal Description of the Land upon which Excavation is Proposed:

That part South Half of Section 28, Township 115, Range 19, Dakota County, Minnesota, lying westerly of the following described line;

Commencing at the northeast corner of the Southeast Quarter of said Section 28; thence South 89 degrees 48 minutes 43 seconds West, assumed bearing along the north line of said Southeast Quarter, a distance of 1058.90 feet to the point of beginning of the line to be described; thence South 18 degrees 23 minutes 48 seconds West a distance 1211.64 feet; thence South 07 degrees 11 minutes 26 seconds East a distance of 1472.46 feet; thence South 75 degrees 07 minutes 52 seconds East a distance of 126.03 feet to the south line of said Southeast Quarter and there terminating.
