RESOLUTION NO. 2011 - 98

A RESOLUTION AUTHORIZING PUBLICATION OF A SUMMARY OF

ORDINANCE NO. B–217 AMENDING THE CITY OF ROSEMOUNT ZONING ORDINANCE B RELATING TO THE FLOODPLAIN DISTRICT

WHEREAS, the Planning Commission of Rosemount recommended City Council approval of this amendment after holding a public hearing on October 25, 2011; and

WHEREAS, the City Council of Rosemount adopted Ordinance No. B-217 amending the City of Rosemount Zoning Ordinance B relating to the floodplain district; and

WHEREAS, Minnesota Statutes, Section 412.191, Subd. 4 allows publication by title and summary in the case of lengthy ordinances; and

WHEREAS, the City Council finds that the following summary would clearly inform the public of the intent and effect of the Ordinance.

NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Rosemount that the City Clerk shall cause the following summary of Ordinance No. B-217 to be published in the official newspaper in lieu of the entire ordinance:

Public Notice

During their November 15, 2011, meeting, the City Council of the City of Rosemount adopted Ordinance No. B-217. The ordinance amends Sections 11-4-19 of Ordinance B, the Zoning Ordinance relating to the floodplain district, as follows:

1.11-4-19.B: National Flood Insurance Program Compliance. This section was added to acknowledge the City’s regulations are compliant with standards for the National Flood Insurance Program and that Rosemount residents and businesses will continue to be eligible for this program.

2.11-4-19.C: Definitions. This section was added to include new definitions for Manufactured Home, Substantial Damage, Substantial Improvement and Recreational Vehicle. While the zoning ordinance has definitions for both Manufactured Home and Recreational Vehicle, the City’s existing definitions do not meet FEMA’s requirements. Substantial Damage and Substantial Improvement are new terms. These definitions were specifically added to the Floodplain district and apply only to this section of the zoning ordinance.

3.11-4-19.D: General Provisions. This section was amended to reference the most recent Flood Insurance Study (FIS) and new Flood Insurance Rate Map (FIRM) and to add new severability, subdivision, annexation and nonconforming standards.

4.11-4-19.E: Floodplain District Regulations. This section was amended to specifically prohibit manufactured homes and recreational vehicles within the Floodplain district. It also expands the prohibition of dredge spoils and sand and gravel operations within the district without an erosion/sedimentation prevention plan. In addition, it adds standards to ensure all structures allow for equalization of hydrostatic pressure.

5.11-4-19.F: Administration and Enforcement. This section was re-titled from Permit Requirements to Administration and Enforcement to accommodate additional permitting standards related to when a permit is required and adds new notification and violation provisions.

6.11-4-19.G: Variances. This section was amended to add additional criteria for granting variances. These criteria prohibit variances that would increase flood levels and require applicants to demonstrate “good and sufficient cause, exceptional hardship, and that the variance will not result in increased flood heights or additional threats to public safety and the like.”

NOW, THEREFORE, BE IT FURTHER

RESOLVED, that a copy of Ordinance No. B-217 shall be kept in the City Clerk’s office at City Hall for public inspection and a full copy of the ordinance be posted in the lobby of City Hall for 30 days after adoption.
