Three fail alcohol compliance checks

Three Rosemount businesses failed recent alcohol compliance checks. Rosemount police chief Eric Werner said MGM Liquors, VFW Post 9433 and American Legion Post 65 all sold alcohol to an underage person.


The department conducted compliance checks on all licensed on-sale and off-sale alcohol retailers in the city from Oct. 18 through Oct. 25. There were 18 checks altogether.

To conduct the checks a member of the department works with an underage individual to try and purchase alcohol from a bar, restaurant or liquor store.

According to a news release, if the clerk or server asks for identification and refuses the sale, the establishment passes the compliance check. If the employee completes the sale, then the establishment fails.

The underage individual uses his or her own identification if asked.

"Our goal is to keep alcohol out of the hands of people under 21. We don't want to see anyone fail," Werner said.

Businesses that pass the checks will receive a letter of appreciation from the department.

This is the first violation for MGM and the VFW. Werner said they are still trying to determine the American Legion's history. Generally the fine for a first violation is $500. The city council will decide the appropriate penalty at an upcoming meeting. Additionally, the person who served the minor can be charged with a gross misdemeanor.

The Invitation Health Institute provided funding for the compliance check through the Enforcing Underage Drinking Laws Program of the Minnesota Department of Safety
