The margin for the city council race was close and could lead to a recount if Tim Judy wants one. Judy received 3,410 votes to finish third in last week's election. Incumbent Mark DeBettignies received 3,436 votes.

Because the margin is so close if Judy requests a recount the city will be responsible for paying for it, said communications director Alan Cox. Judy can request a recount after the council has canvassed the results. The council will meet Nov. 10 for that purpose.

According to Minnesota State Statute a losing candidate election for a municipal office may request a recount if the difference between the vote cast for that candidate and for a winning candidate is less than one-half of one percent of the total votes counted for that office. In case of offices where two or more seats are being filled from among all the candidates for the office, the one-half of one percent difference is between the elected candidate with the fewest votes and the candidate with the most votes from among the candidates who were not elected.

In an e-mail Judy said he will not decide until after the results have been canvassed whether he will request a recount. Judy said he has not been contacted by the city about his options.

Cox said the actual ballots have gone under lock and key. When the council canvasses the results it will use the computer print outs from the machines. If Judy requests a recount then the ballots will be manually counted.

Cox said if Judy does request a recount the city will try to do it before the end of the November when Dakota County will likely want the ballots for the governor's race recount.
