THAT pursuant to said Declaration, there is claimed to be due and owing as of April 15, 2004 from Deborah K. Andreivich and Lawrence W. Brauer, title holders, to Riverbluff Homeowners Association, a Minnesota non-profit corporation, the principal amount of Four Thousand Six Hundred Thirty Eight and 53/100 ($4,638.53) for assessments (past and accelerated), late fees and collection costs, plus assessments and other amounts that have accrued since that date, including the costs of collection and foreclosure;

THAT no action is now pending at law or otherwise to recover said debt or any part thereof;

THAT the owner had not been released from his financial obligation to pay said amount;

THAT pursuant to Minn. Stat. §515a.3-115(a), said debt creates a lien upon said premises in favor of Riverbluff Homeowners Association as evidenced by a lien statement effective March 14, 1994 and dated December 14, 2007, and recorded on December 19, 2007, in the office of the Dakota County Recorder as Document No. 2562176.

THAT pursuant to the power of sale granted by the owners in taking title to the premises subject to said Declaration, said lien will be foreclosed by the sale of said property by the sheriff of said county at the Dakota County Law Enforcement Center, 1580 Highway 55, Hastings, MN 55033, Dakota County on the 19th day of March, 2008, at 10:00 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said assessments, together with the costs of foreclosure, including attorneys fees as allowed by law.
