Near miss with squad car leads to DWI charges

A 21-year-old Mantorville man's lack of control on the roads got the wrong kind of attention from a Dakota County Sheriff's deputy last month.

According to a complaint filed in the Dakota County Attorney's office, Rocky Andrew Copley swerved over the centerline of County Road 46 Dec. 21 and nearly forced a sheriff's deputy into the ditch. The deputy turned around to follow Copley and stopped him after watching his car straddle the centerline as oncoming vehicles approached, forcing those cars toward the ditch.

Copley's speech was slow and he seemed confused when the deputy talked to him. Copley failed field sobriety tests and a preliminary breath test indicated a blood alcohol level greater than .08. A breath test given later at the Dakota County Jail showed a blood alcohol content of .22, more than twice the legal limit.

Copley was convicted of impaired driving in March of 2007. This time around he faces one second degree DWI charge and one third degree DWI charge. Each carries a potential sentence of up to one year in jail and fines of up to $3,000.
