ASSOCIATION LIEN Foreclosure SALE
WHEREAS, default has been made in the terms and conditions of the Declaration for Diffley Commons 2nd Addition Villas and Garden Homes,Condominium Number 116, (henceforth the Declaration) dated March 18, 1994, and recorded in the office of the County Recorder in and for Dakota County, Minnesota on March 22, 1994 as Document No. 1203482, which said Declaration covers the following described property situated in the County of Dakota and State of Minnesota, to-wit:
Unit 105, Condominium No. 116, Diffley Commons 2nd Addition Villas and Garden Homes, a condominium located in Dakota County, Minnesota.

WHEREAS, pursuant to said Declaration, there is claimed to be due and owing as of the date of this Notice by John Alstatt and Beverly Alstatt as unit owners to Diffley Commons 2nd Addition Villas and Garden Homes Homeowners Association, the principal amount of One Thousand Nine Hundred Thirteen Dollars and No/100 ($1,913.00) for condominium assessments through January, 2009; and no action being now pending at law or otherwise to recover said debt or any part thereof, and;
WHEREAS, pursuant to said Declaration, and the statute in such case made and provided, said debt creates a lien upon said premises in favor of Diffley Commons 2nd Addition Villas and Garden Homes Homeowners Association.
NOW, THEREFORE, notice is hereby given that by virtue of the power of sale created by statute, said lien will be foreclosed by the sale of said premises with the hereditaments and appurtenances, which said sale will be made by the Sheriff of Dakota County, Minnesota at the Sheriff's main office in the Dakota County Courthouse Civil Division, 1580 Highway 55 - lobby S-100, in the City of Hastings in said County on April 30, 2009 at 10:00 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said condominium assessments, together with the costs of foreclosure, including attorney's fees as allowed by law. The time allowed by law for redemption by the unit owners, their personal representatives or assigns, is six (6) months from the date of said sale.

Pursuant to the provisions of Minn. Stat. §580.07, the foregoing foreclosure is postponed at the request of Diffley Commons Second Addition Villas and Garden Homes Homeowners Association to May 27, 2009, at the Sheriff's Main Office in the Dakota County Courthouse, Civil Division, 1580 Hwy 55 - Lobby S-100 in the City of Hastings, County of Dakota, State of Minnesota.
