May 5, 2009
The Dakota County Board of Commissioners met at 9:03 a.m. on Tuesday, May 5, 2009, in the Boardroom, Administration Center, Hastings, Minnesota. All County Board members were present except Commissioner Joseph A. Harris. The minutes of the County Board meeting, held April 21, 2009, were approved as presented and entered in Commissioners' Record MM.
The following revision was made to the agenda: Item 16.2 - Other Board Activities was corrected to reflect Monday, May 11, 2009 - Dakota County Library Board Meeting.
Public Health Director Bonnie Brueshoff introduced Item 12.1 - Update On H1N1 Novel Influenza Virus and responded to questions from the Board. Risk Homeland Security Manager B.J. Battig discussed infection control strategies.
OPERATIONS, MANAGEMENT, AND BUDGET
Authorized execution of a contract with the Minnesota Department of Public Safety, Division of Homeland Security and Emergency Management, for the 2008 Homeland Security Grant and amended 2009 Operations Management budget.
Conducted a public hearing to receive comments on Item 5.2 - Public Hearing to Receive Comments On And Approval Of Dakota County's Federal Fiscal Year (FFY) 2009 One Year Action Plan For Community Development Block Grant (CDBG) And Home Investment Partnership Program (HOME). Dakota County Community Development Agency (CDA) Director of Community Revitalization Dan Rogness presented this item. Interested persons desiring to be heard were afforded the opportunity to address the County Board. No one appeared. Approved the Dakota County Consortium's 2009 One-Year Action Plan to be submitted to the U.S. Department of Housing and Urban Development (HUD and authorized execution of related agreements. Designated the Dakota County CDA Director of Community Revitalization as the certifying officer for environmental reviews associated with these programs.
Approved the Low Income Housing Tax Credit Qualified Allocation Plan of the CDA for 2010.
Authorized execution of an amendment to the agreement with the CDA for administration of the Neighborhood Stabilization Program grant funds received from HUD.
Authorized execution of a Joint Powers Agreement with the Minnesota Department of Natural Resources (DNR) to provide aquatic and angling education programming.
Approved sponsorship of the grant applications of Dakota Trail Association, Inc., the Inver Grove Heights Connections Snowmobile Club, and the Waterford Warriors Snowmobile Club, Inc. (Clubs) for the 2009-2010 season to the DNR and authorized execution of related agreements.
Rescinded Resolution No. 09-098. Authorized execution of agreements with the Minnesota Department of Transportation (Mn/DOT) and the Union Pacific Railroad (UPR) where Dakota County and Mn/DOT will reimburse UPR for costs to install railroad crossing signals, concrete surface improvements, and gates on County Road 96 as specified.
Authorized execution of the quit claim deed releasing the foot drainage, utility and trail easement in Parcel 21, Dakota County Right of Way Map No. 311 in exchange for a retaining wall easement in that parcel.
Authorized execution of an agreement with UPR where Dakota County will reimburse UPR for costs to install concrete surface improvements on 65th Street for County Project (CP) 56-07 and the Mississippi River Regional Trail.
Awarded the bid to and authorized execution of the following contracts: 1) AAA Striping Service Company for CP 97-92 epoxy pavement markings at locations on the county highway system and amended the 2009 Transportation Capital Improvement Program (CIP) budget; and 2) Collins Electrical Systems, Inc. for CP 28-43.
Authorized revoking County State Aid Highway (CSAH) 5 status (old alignment) and designated a new alignment to CSAH 5 in Lakeville.
Authorized execution of an agreement with Mn/DOT and the City of Inver Grove Heights (IGH) for CP 28-47, to define cost, operation and maintenance responsibilities for installation of new traffic control signals along CR 28 at the State Highway 52 ramps. Authorized execution of a separate agreement with IGH for CP 28-47, for cost sharing of a replacement cabinet at CR 28 and Blaine Avenue. Amended the 2009 Transportation Capital CIP budget.
Conducted a public hearing to receive comments on Item 5.1 - Receive Public Comment On Dakota County's Application For Edward Byrne Memorial Justice Assistance Grant Formula (EBMJAG) Program: Local Solicitation (Recovery Act). Chief Deputy Sheriff Dave Bellows introduced this item. Interested persons desiring to be heard were afforded the opportunity to address the County Board. No one appeared.
Authorized entering into a Joint Powers Agreement with the Cities of Apple Valley, Burnsville, Eagan, Hastings, Inver Grove Heights, Lakeville, Rosemount, South St. Paul, and West St. Paul to fulfill requirements in our application to the federal government under the EBMJAG Program.

Approved the following plat, approved by the respective City Council, and submitted it for recording: USPS Eagan Addition, Eagan.
