July 21, 2009

The Dakota County Board of Commissioners met at 9:02 a.m. on Tuesday, July 21, 2009, in the Boardroom, Administration Center, Hastings, Minnesota. All County Board members were present. The minutes of the County Board meeting, held July 7, 2009, were approved as presented and entered in Commissioners' Record MM.

Chair Gaylord asked if there was anyone in the audience who wished to address the County Board on an item not on the agenda or any item on the consent agenda. No one appeared.


The following revision was made to the agenda: Added Item 16.2 - Authorization To Amend Joint Powers Consortium Agreement For HOME Investment Partnership Program To Provide For City Of Woodbury Membership In Consortium.

Received the following 2009 National Association of Counties Achievement Awards: 1) 21st Century Gathering Center Reflecting 8,000 Years Along The Mississippi River presented by the Environmental and Natural Resources Director; and 2) Improving Efficiency in Fleet Capital Acquisition and Replacement presented by the Operations Management Director. Staff was recognized for their efforts with these projects.


Authorized execution of a joint powers agreement between Dakota, Rice and Goodhue Counties to apply, receive, and administer Federal Juvenile Accountability Block Grant funds used to reform juveniles in the juvenile or criminal justice systems.


Community Corrections:

Authorized submission of grant applications to the Minnesota Department of Public Safety Office of Justice Programs/Byrne Justice Assistance Grants for the following: 1) Continue funding for the Drug Court Probation Officer; 2) Pilot an Evening Learning Center as a detention alternative; and 3) Purchase data analysis services to support the Juvenile Detention Alternatives Initiative.

Employment And Economic Assistance (E and EA):

With the concurrence of Dakota-Scott Workforce Investment Board (WIB), authorized execution of the following: 1) Contracts with the Minnesota Department of Employment and Economic Development (DEED) Job Service and HIRED to provide employment and training services for the Federal Dislocated Workers Program; and 2) Ratified the FastTRAC Supplemental Plan submitted by WIB and authorized execution of a grant agreement with DEED to fund the Plan; 3) Contract with Special School District #6 for curriculum development, instruction, and evaluation of the FastTRAC program; 4) Ratified the Low Income Grant application submitted to DEED to add low income grant funds; 5) Contract with Goodwill/Easter Seals to provide quarterly bank skills training; and 6) Contract with the Dakota County Technical College to provide quarterly soldering training. Amended the 2009 E and EA budget for these programs.

Authorized execution of a contract with HIRED to provide the Job Advance program to add supported work funds. Amended the 2009 E and EA budget.

Proclaimed August 2009 as Child Support Awareness Month in Dakota County. Extended appreciation to the dedicated child support workers, clerks of court, attorneys, magistrates, and judges who diligently work to establish and enforce child support obligations for families.

Social Services:

Authorized execution of a contract with Janice Stickney for emergency shelter services.

Ratified a grant application for American Recovery and Reinvestment Act funds submitted to the Minnesota Department of Human Services for homelessness prevention and rapid re-housing services.

Authorized execution of the following Grant agreements: 1) The Saint Paul Foundation for outreach, homelessness prevention and rapid re-housing services; and 2) U.S. Department of Housing and Urban Development for Housing and Urban Development Homeless Prevention and Rapid Re-Housing program funding. Amended the 2009 Social Services budget for these programs.



Authorized submission of a grant application to the Minnesota Department of Public Safety Office of Justice Programs/Byrne Justice Assistance Grant for the Dakota County Criminal Justice Information Integration Network for a Regional Police Records Management System.

Information Technology:

Authorized execution of a contract with Qwest Corporation for telephone services at Northern Service Center.



Scheduled a County Board Workshop for Tuesday, September 22, 2009, at 11:00 a.m., in Conference Room 3A in the Administration Center, Hastings, Minnesota, to receive energy policy recommendations.

Dakota County Community Development Agency (CDA) Executive Director Mark Ulfers introduced Item 16.1 - Approval Of Revisions To Substantial Amendment To Dakota County's 2008 One Year Action Plan For Community Development Block Grant (CDBG) For CDBG Recovery Program Funding. Approved revising the substantial amendment to Dakota County's 2008 One Year Action Plan for CDBG Recovery Program Funding.

Mr. Ulfers also introduced Item 16.2 - Authorization To Amend Joint Powers Consortium Agreement For HOME Investment Partnership Program To Provide For City Of Woodbury Membership In Consortium. He and HOME Program Coordinator Stephanie Newberg responded to questions regarding Woodbury's membership in the Joint Powers Consortium. Authorized execution of the Joint Powers Consortium Agreement to permit Woodbury to join the Consortium.

Environmental Management:

Authorized execution of a Cooperative Agreement with the Minnesota Department of Agriculture to fund business and household waste pesticide management.

Farmland And Natural Areas Program (FNAP):

Authorized staff to initiate negotiations with the following highest ranked 2009 farmland protection projects: 1) Ronald and Robin Bakken, Sciota; 2) Dolores Gergen, Hampton; 3) Michael Ozmun, Waterford; 4) Robert Jr. and Nancy Kluver, Greenvale; 5) Lewellyn and Bernadette Stoffel, Vermillion; 6) Marian Frandrup/Arthur Frandrup Estate, Hampton; 7) Jay and Kerry Otte, Waterford; 8) Jerold and Karen Otte, Hampton; and 9) Mark and Janet Otte, Randolph. Landowners willing to sell a permanent agricultural conservation easement to Dakota County will be reviewed and presented to the County Board for final acquisition.


Authorized establishing the Dakota County Friends of the Parks Program to increase park system usage. Beneficial relationships with park advocates through a new Dakota County Park System Friends Group will engage supporters to help increase park awareness, usage, programs, resources, and funds.

Authorized execution of the following: 1) Contract amendment with Toltz, King, Duvall, Anderson, and Associates, Inc. for additional design and engineering of the central segment of the Mississippi River Regional Trail; and 2) Cooperative Agreement No. 73-6322-9-01 with the United States Commodity Credit Corporation through the Natural Resources Conservation Service for Fiscal Year 2009 Farm and Ranch Lands Protection Program.


Recommended that the Metropolitan Council select funding options 1, 2 or 3 of the 6 Dial A Ride (DAR) Funding Formulas that provide the most revenue for DAR services to Dakota County residents including seniors.

Authorized revoking County State Aid Highway (CSAH) status and designated County Road status to CSAH 24 in Inver Grove Heights.

Authorized the following: 1) Execution of an agreement with Eagan for County Project (CP) 97-35, for bikeway trail reconstruction/bituminous overlays; and 2) Changing traffic control and the installation of all-way stop signs at the intersection of County Road (CR) 64 (195th Street) and Flagstaff Avenue and retention of the existing all-way stop condition at the intersection of CR 64 and Akin Road.

Water Resources Office:

Authorized submission of Brownfield Assessment Grants applications to the U.S. Environmental Protection Agency to restore contaminated sites.



Authorized execution of a contract with the State of Minnesota Department of Public Safety, Division of Emergency Management for Radiological Emergency Preparedness Grant funding. Amended the 2009 Sheriff's Emergency Services budget.



Rescinded Resolution Numbers 01-481 and 08-323 and adopted the revised Aggregate Tax Policy.

Approved the Public Art Citizen Advisory Committee's recommendations for art placement changes for the Judicial Center and Western Service Center. Directed staff to work with the Dakota County Historical Society and Facilities Management to help facilitate this project.

Property Taxation And Records:

Approved the following applications for Assemblage of Large Numbers of People license and issuance of licenses upon payment of the proper fees: 1) Dakota County Agricultural Society, Inc. for a motocross event held July 24, 2009, at the Dakota County Fairgrounds; and 2) Little Log House Properties, Inc. for an event held July 24-26, 2009, at 21889 Michael Avenue, Hastings.

Approved the following plats, approved by the respective City Council, and submitted it for recording: 1) Thompson Heights, South St Paul; and 2) Loch Addition, Apple Valley.



Received the County Administrator's Report that included a report on 2008 Dakota County Population Estimates received from the Metropolitan Council presented by the Dakota County Office of Planning and Analysis Management Analyst.

County Board:

Received a summary of conclusions of the closed executive session of the County Administrator's mid-year performance review.

Financial Services:

Received the Report On Invoices Paid in June 2009.

The County Board meeting was adjourned at 10:16 a.m.

The next regular Dakota County Board meeting will be held August 4, 2009, at 9:00 a.m.
