The Dakota County Board of Commissioners met at 9:03 a.m. on Tuesday, November 25, 2008, in the Boardroom, Administration Center, Hastings, Minnesota. All County Board members were present. The minutes of the County Board meeting, held November 4, 2008, were approved as presented and entered in Commissioners' Record MM.
Authorized execution of grant agreements with community agencies for human services related programs.
Authorized execution of a contract with Midwest Monitoring & Surveillance, Inc. for electronic home monitoring and related services.
Approved the 2009 per diem for the Juvenile Services Center.
Approved and authorized execution of the Minnesota Counties Computer Cooperative Joint Powers Agreement and related amendment.
Authorized execution of contracts with the following vendors for services: 1) Patricia Orud, Pathways Psychology, Project Pathfinder, Inc., and Veracity Research, Inc. for sex offender treatment services; 2) Children's Home Society and Family Services for domestic violence education services to offenders; 3) General Security Services Corporation for secure transportation services for juveniles and Sentence to Service programming for offenders; and 4) Create, Inc. for Driving With Care Services.
Employment And Economic Assistance:
Authorized execution of contracts with Hastings Family Services, Inc., Community Action Council, Inc., and Neighbors, Inc. to deliver emergency cash assistance services.
Authorized execution of contract with Tree Trust to provide the Unpaid Work Experience Program for eligible Minnesota Family Investment Program participants in Dakota County.
Authorized execution of Dakota Healthy Families Contracts with the Community Action Council, Inc., Scott Carver Dakota CAP Agency, Inc., and Independent School District 197 for home visiting services.
Accepted the Public Health Preparedness, the Cities Readiness Initiative, and the Fairview Ridges award. Authorized execution of grant agreements with the Minnesota Department of Health to carry out the proposed Public Health Preparedness, Cities Readiness Initiative in the amounts of the grants awarded.
Accepted the award from Blue Cross and Blue Shield of Minnesota (BCBS) for Prevention Minnesota: Healthy Eating Minnesota program to increase healthy eating, especially fruit and vegetable consumption. Authorized execution of an agreement with BCBS to carry out the proposed activities, in the amount of the funds awarded.
Authorized execution of contracts with the following vendors for services: 1) Focus On Living, Inc. for corporate foster care services; 2) Community Improvement Program, Inc., Lifeworks Services, Inc., and Mankato Rehabilitation Center, Inc. for Fiscal Support Entity, Fiscal Intermediary, and Employer of Record services; 3) Mental Health Resources, Inc. to provide supportive housing services; 4) GAPP Services, Inc., Hastings Family Services, Inc., and Neighbors, Inc. for volunteer driver transportation services; and 5) specified community-based and in-home providers for mental health treatment services for youth and families.
OPERATIONS, MANAGEMENT, AND BUDGET
Approved the Dakota County Legislative Program recommendations for 2009 as summarized.
Office of Planning And Analysis:
Scheduled a public hearing for December 16, 2008, at 9:00 a.m., in the Board Room, Dakota County Administration Center, Hastings, Minnesota, to receive public comment on the draft Dakota County Comprehensive Plan. Directed staff to publish the public hearing notice in the official County newspaper.
Authorized execution of a contract amendment to the employee interchange agreement with the South Metro Fire Department and Michael Pott for homeland security support services.
Rescinded Resolution No. 08-388. Authorized execution of a lease amendment with the State of Minnesota Department of Administration, for an additional five (5) year term, at the specified terms, to house Department of Employment and Economic Development staff at the Northern Service Center.
Operations Management Director Taud Hoopingarner introduced Item 13.1 - Request for Authorization To Participate In State Of Minnesota Fuel Consortium Program and responded to questions from the Board. Authorized purchasing 67 percent or 129,100 gallons of our estimated unleaded, and 64 percent or 100,400 gallons of our estimated diesel fuel needs for 2009 through the State Fuel Consortium Fixed Price Program and the remaining amount of fuel necessary for County Fleet operations from the State Spot Price Program or local spot price vendors.
Scheduled a public hearing for December 16, 2008, at 9:00 a.m., in the Board Room, Dakota County Administration Center, Hastings, Minnesota, to receive public comment on an Official Mapping Ordinance. Directed staff to publish the public hearing notice in the official County newspaper.
Approved a substantial amendment to Dakota County's 2008 One Year Action Plan for Community Development Block Grant to receive funding from the Neighborhood Stabilization Program (NSP). Authorized signing the U.S. Department of Housing and Urban Development (HUD) application for NSP funds and required certifications. Authorized execution of the NSP Agreement with HUD for the acceptance of NSP funding.
Ratified community development funding requests to HUD.
Community Development Agency Director Mark Ulfers introduced Item 14.1 - Approval Of 2009 Levy For Dakota County Community Development Agency (CDA) For Affordable Housing and responded to questions from the Board regarding current CDA projects. Approved increasing the CDA's levy of special benefit taxes from .0144% to .01813% of taxable market value for taxes payable in 2009, for the purpose of leveraging the development of additional affordable housing in Dakota County through the Dakota County Housing Opportunities Enhancement (HOPE) Fund. The CDA shall report at least annually to the Board on its use of the Incremental Levy to achieve the purposes of the HOPE Fund.
Approved issuance of a solid waste facility license for Allied Waste Services to operate a Type A yard waste composting facility in the City of Inver Grove Heights, subject to compliance with all applicable federal, State, local, and County laws, rules, and ordinance requirements, and specified conditions.
Approved issuance of a license to SKB Environmental, Inc. (SKB) for a solid waste transfer station, as a part of the multiple operation solid waste facility license at SKB's Rosemount location, subject to compliance with all applicable federal, State, local, and County laws, rules, and ordinance requirements, and specified conditions.
Authorized execution of Hauler Financial Incentive Payment Program contracts with haulers for municipal solid waste generated in Dakota County that is delivered to and verifiably processed at County-approved processing facilities.
Approved SKB's proposal to construct a new waste containment cell for receipt of 3M Company dump site wastes, as detailed in SKB's addendum to its permit application to the Minnesota Pollution Control Agency. Approved issuance of a license to SKB for the industrial waste landfill portion of its multiple operation solid waste facility license, subject to compliance with all applicable federal, State, local, and County laws, rules, and ordinance requirements, and specified conditions.
Approved SKB's proposal to process mixed municipal solid waste and industrial wastes, including waste combustor ash. Approved issuance of a license to SKB for its waste processing facility portion of its multiple operation solid waste facility license, subject to compliance with all applicable federal, State, local, and County laws, rules, and ordinance requirements, and specified conditions.
Authorized execution of an agreement with the State of Minnesota for the provision of a part-time Institution Community Work Crew.
Authorized execution of the Joint Powers Agreement with the University of Minnesota to provide trail snow grooming services at Vermillion Highlands.
Conducted a public hearing to receive comments on Agenda Item 5.2 - Public Hearing To Receive Comments On Ordinance No. 126 Management Of Public Right Of Way. Traffic Engineer Kristi Sebastian introduced this item. Interested persons desiring to be heard were afforded the opportunity to address the County Board. No one appeared.
Authorized execution of a quit claim deed for a gravel pit located in Greenvale Township in favor of Wayne and Candace Hallcock. The property exchange will reduce the amount of excess and unneeded land held by the County, obtain needed County State Aid Highway 86 right of way at no additional cost, and simplify and facilitate the Farmland and Natural Areas Program.
Approved payment to Progressive Rail Incorporated for rail crossing improvements at three locations on County roads located in Eagan and amended the Transportation Capital Improvement Program (CIP) budget.
Authorized execution of an agreement with the Minnesota Department of Transportation and the City of Burnsville for County Project 30-16 and amended the Transportation CIP budget.
Authorized execution of contracts with the following providers to service Dakota County Jail inmates: Merwyn Pharmacy for pharmaceutical services and Allina Medical Clinic for jail medical services.
Authorized execution of a contract with Intermediate School District 917 for the position of school resource officer at the IDEA/Students with Unique Needs (SUN) Program.
PUBLIC SERVICES AND REVENUE
Property Taxation And Records:
Approved the Department Of Natural Resources application to acquire a tax-forfeited parcel located in Inver Grove Heights.
Approved granting permanent drainage and utility easement to the City of Eagan over a tax-forfeited parcel located in Eagan and authorized execution of the easement.
Approved the application from the City of Rosemount for the conveyance of a parcel of tax-forfeited land.
Approved the following plats, having been approved by the respective City Councils, and submitted them to the Property Taxation and Records Department for recording: River Hills Substation, Eagan; Primrose of Lakeville, Lakeville, and Diffley Marketplace Second Addition, Eagan.
COUNTY BOARD/COUNTY ADMINISTRATION
Held a closed executive session to discuss the case of County Of Dakota V. Lakeville Land, Ltd., Et Al. Approved the settlement agreement and authorized payment to Lakeville Land, Ltd., Et Al.
Held a closed executive session to evaluate the performance of the County Administrator.
Authorized execution of an amendment to the 2006 - 2007 benefits consulting contract with Deloitte Consulting, LLP, increasing the professional fees payable pursuant to the contract for benefits consulting.
Authorized renewal of an agreement with SuccessFactors, Inc. to access the web-based performance management subscription service.
Conducted a public hearing to receive comments on Agenda Item 5.1 - Public Hearing To Receive Comments On 2009-2013 Capital Improvement Program. Budget Director Brent Gustafson introduced this item. Interested persons desiring to be heard were afforded the opportunity to address the County Board. No one appeared.
Received the Report On Invoices Paid in October 2008.
