The Dakota County Board of Commissioners met at 9:04 a.m. on Tuesday, April 7, 2009, in the Boardroom, Administration Center, Hastings, Minnesota. All County Board members were present except Commissioner Paul J. Krause. The minutes of the County Board meeting held March 17, 2009, were approved as presented and entered in Commissioners' Record MM.
Chair Gaylord asked if there was anyone in the audience who wished to address the County Board on an item not scheduled on the agenda or on any item on the consent agenda. The following individual appeared and made comment regarding Item 13.1 - Imposition Of Civil Penalty For Violation Pursuant To Section 24 Of Dakota County Ordinance 101 Regulating The Licensing And Sale Of Non-Intoxicating Malt Liquor (On Sale And Off Sale) And Intoxicating Liquor (On Sale And Off Sale): Tom Furlong, Hastings.
The following revision was made to the agenda: Moved the following from consent agenda to regular agenda: Item 8.6 - Authorization To Execute Agreement With Union Pacific Railroad Company For Rail Crossing Improvements At County State Aid Highway 46 Within City Of Rosemount, County Project 46-33.
Employment And Economic Assistance:
Authorized execution of an Interagency Agreement with the Department of Human Services (DHS) for access to the DHS Warehouse Database.
Authorized execution of contracts with the following organizations: 1) Minnesota Department of Veterans Affairs, Hastings Veterans Home, for up to seven quarantine beds in the event of pandemic flu or infectious disease outbreak; and 2) Regency Home Health Care Services, LLC, to provide 24-hour customized living and assisted living plus services.
Authorized submission of an application for State Health Improvement Program Funds from the Minnesota Department of Health.
Proclaimed April 6-12, 2009, as Public Health Week in Dakota County, and supported efforts aimed at Building the Foundation for a Healthy America.
Presented the 2009 Public Health Achievement Awards for three categories to the following individuals and organization: 1) Youth: Melissa Wells; 2) Individual: Michael Funk; and 3) Community: Randolph School District 195. Chair Gaylord individually recognized each of the award recipients by highlighting their achievements and contributions in promoting the health of the public in Dakota County and presented them with plaques. A reception was held in honor of the 2009 Public Health Achievement Awards recipients.
Authorized execution of a contract/agreement with the following providers: 1) Contract with Blue Plus to provide care coordination services for Dakota County residents enrolled in special needs basic care products; and 2) East Metropolitan Adult Crisis Stabilization (EMACS) Cooperative Agreement with Ramsey County and appointed Patrick Coyne and David Rooney to serve as the Dakota County representatives on the EMACS governing board.
OPERATIONS, MANAGEMENT, AND BUDGET
Authorized purchasing Data Switches to maintain a local area network from CDW, Inc.
Approved the 2009 work plans for the Parks and Recreation Advisory Committee, the Planning Commission and the Farmland and Natural Area Program Advisory Committee.
Authorized execution of Joint Powers Agreements with the cities of Hastings, Lakeville, Farmington, Burnsville, and the Rural Solid Waste Commission, to plan and conduct one-day Household Hazardous Waste collection events in 2009.
Approved a Special Hazardous Waste Facility License for Materials Processing Corporation, Eagan, based on their compliance with all applicable federal, state, local, and county laws, rules, and ordinance requirements, and special conditions.
Approved the Certification of Closure for the Resource Recovery Technologies Processing Solutions Yard Waste Composting Facility, Rosemount, and released all financial assurance provided by them for operation of the facility.
Authorized execution of the following agreements/contract amendments: 1) Agricultural lease agreements with certain individuals for use of specified County land at specified rates and durations; 2) Contract amendment with Kimley-Horn and Associates, Inc., for additional design and engineering services for the Mississippi River Regional Trail (MRRT) in Inver Grove Heights; and 3) Contract with the State of Minnesota for the provision of one 10-person full-time Institution Community Work Crew.
Approved the preferred MRRT alignment in Inver Grove Heights from Concord Boulevard and 80th Street on new Concord Boulevard - east side, to Cahill Avenue - west side, to Inver Grove Trail.
Authorized execution of the following agreements/contracts: 1) Grant agreement with the Minnesota Department of Transportation (Mn/DOT) for County Project (CP) 54-07 and CP 91-15 and amended the 2009 Transportation Capital Improvement Program (CIP) budget; 2) Agreement No. 94354 with Mn/DOT for the Trunk Highway (TH) 35E detour, State Project (SP) 1982-156; 3) Agreement No. 94258 with Mn/DOT for TH 55 detour, SP 1910-43; 4) Agreement with Eagan and Inver Grove Heights for CP 97-85, Regional Roadway System Visioning Study (RRSVS); 5) Agreement No. 94035 with Mn/DOT for CP 97-85, RRSVS; 5) Contract with SRF Consulting Group, Inc. for CP 97-85, RRSVS; and 6) Agreement with Union Pacific Railroad Company for railroad crossing improvements on CP 46-33 and amended the 2009-2013 Transportation CIP budget.
Released a portion of County's easement rights over parcels 12, 13 and 13A(300) on County State Aid Highway 70, CP 70-06.
Approved acquisition of and authorized County Attorney to initiate "quick take" condemnation of right of way for CP 56-07 in Inver Grove Heights and South St. Paul.
Awarded the bid and authorized execution of contracts with the following contractors: 1) Dustcoating, Inc. for purchase and application of chloride on Dakota County roads; and 2) Solberg Aggregate, Inc. for supplying crushed quarry rock to resurface County roads for CPs 59-03, 80-10, 80-11, 84-03, 89-04, 90-02, and 91-18.
Approved submission of an application to participate in the Integrated Emergency Management Course (IEMC) at the Emergency Management Institute (EMI) in Emmitsburg, Maryland and authorized signing a Letter of Support.
Authorized signing a Letter of Agreement with the Department of Homeland Security, Federal Emergency Management Agency to participate in the IEMC at the EMI.
PUBLIC SERVICES AND REVENUE
Deputy Public Services and Revenue Director Jean Erickson introduced Item 13.1 - Imposition Of Civil Penalty For Violation Pursuant To Section 24 Of Dakota County Ordinance 101 Regulating The Licensing And Sale Of Non-Intoxicating Malt Liquor (On Sale And Off Sale) And Intoxicating Liquor (On Sale And Off Sale). Ms. Erickson reviewed the procedures outlined in County Ordinance 101 in relation to violation by Emerald Greens Golf, LLC., licensee. The licensee, Tom Furlong, also addressed the Board. Imposed a civil penalty for violation to Dakota County Ordinance 101 regulating the licensing and sale of non-intoxicating malt liquor and intoxicating liquor.
Property Taxation And Records:
Approved the following applications from: 1) Burnsville to acquire a tax-forfeited parcel; and 2) Newman Golf Investors, LP doing business as Southern Hills Golf Course for a license to sell intoxicating liquor and authorized issuance of the license upon payment of the fees.
COUNTY BOARD/COUNTY ADMINISTRATION
Appointed Daniel Monahan to the Dakota Scott-Workforce Investment Board.
Received a Legislative Update.
Authorized issuing Request for Proposals (RFP) for a new Enterprise Resource Planning System. Directed staff to return to the County Board for approval of the contract based on the RFPs submitted.
The County Board meeting was adjourned at 11:41 a.m.
The next regular Dakota County Board meeting will be held April 21, 2009, at 9:00 a.m.
